Public Offer Agreement for Online Sale of Goods
1. General Provisions
1.1. This document constitutes a public offer from Golden Trail LLC (TIN: 1308261351) (hereinafter referred to as the “Seller”). It contains all essential terms for the remote sale of disposable products for beauty salons, clinics, and aesthetic rooms (including gloves, masks, sheets, caps, etc.) (hereinafter referred to as the “Goods”).
1.2. By placing an order on the website www.goldentrail.az (the “Website”), the Buyer signifies full and unconditional acceptance of the terms of this Offer.
1.3. This Offer is considered concluded from the moment the Buyer confirms the order and operates in accordance with the Civil Code of the Republic of Azerbaijan.
2. Subject of the Agreement
2.1. The Seller agrees to transfer, and the Buyer agrees to accept and pay for, the Goods ordered on the Website.
2.2. The quantity, cost, and characteristics of the Goods are determined at the time of order placement.
3. Ordering and Payment Procedure
3.1. Orders are placed by selecting items on the Website and confirming the order through the electronic form.
3.2. Payment can be made online (via bank card or electronic wallet) or in cash upon delivery (if applicable).
3.3. All prices are listed in Azerbaijani Manats (AZN) including VAT. Delivery costs are not included unless stated otherwise.
4. Delivery and Transfer of Goods
4.1. Delivery is carried out by courier, postal services, or transport companies. Terms and costs are specified during the checkout process.
4.2. The risk of accidental loss passes to the Buyer once the Goods are handed over to the courier or transport company.
5. Returns and Exchanges
5.1. In accordance with legislation, incorrectly sent or defective Goods may be returned or exchanged for proper items.
5.2. Pursuant to the Law of the Republic of Azerbaijan “On Protection of Consumer Rights,” hygienic products showing signs of use are not eligible for exchange.
6. Liability
6.1. The Seller is not liable for the Buyer’s inability to use the Goods due to personal reasons.
6.2. The Seller is not responsible for delivery delays caused by third parties.
7. Personal Data
7.1. By placing an order, the Buyer consents to the processing of their personal data in accordance with the Law of the Republic of Azerbaijan “On Personal Data”.
8. Final Provisions
8.1. This Offer remains in effect indefinitely until revoked by the Seller.
8.2. Any disputes shall be resolved through negotiations. If an agreement is not reached, disputes shall be settled by the relevant court located in Baku.
2. Website User Agreement
1. General Provisions
1.1. This User Agreement (the “Agreement”) governs the relationship between the Administration of www.goldentrail.az and any user (the “User”).
1.2. Use of the Website implies the User’s full agreement with the terms of this Agreement.
2. Registration and Account
2.1. To place an order, the User must register by providing accurate personal data.
2.2. The User is responsible for the security of their account credentials.
3. Rights and Obligations
3.1. The Administration has the right to:
Change Website content;
Suspend access to the Website for technical maintenance.
3.2. The User agrees to:
Not use the Website for illegal activities;
Provide accurate information when placing an order.
4. Intellectual Property
4.1. All Website materials (texts, images, logos) are subject to copyright. Their use is permitted only with written consent from the Administration.
5. Limitation of Liability
5.1. The Administration is not liable for:
Temporary unavailability of the Website;
Actions of third parties leading to malfunctions or data leaks.
6. Personal Data
6.1. Use of the Website implies consent to the processing of personal data in accordance with the legislation and the Law of the Republic of Azerbaijan “On Personal Data”.
7. Final Provisions
7.1. The Administration may amend this Agreement at any time without prior notice. Changes take effect upon being posted on the Website.
7.2. Continued use of the Website after changes are posted signifies the User’s acceptance of the new version.
